If you have a traffic accident, the first thing to keep in mind is the following:
- Safety measures must be complied with, i.e. use the reflective vest and breakdown triangles. This is called the PAS technique: protect+warn+run. Special attention should be paid to other vehicles, as many hit-and-run accidents occur when assisting victims of other accidents.
- In the event of injuries, the emergency service should be contacted at 112.
If you are the driver of the vehicle…
- You will be able to choose between the public and/or private centers offered by the insurer, unless you are at fault in the accident, there are no other vehicles involved and you are only insured to third parties.
- Fill in the assistance report
- Report the accident to the insurance company within seven days after the accident.
If you are one of the injured…
- You will have the option to choose which medical center to go to, either private or public. The insurer of the vehicle responsible for the accident will be in charge of paying the expenses.
- It is recommended to claim for the damages caused as soon as possible.
- Those seriously injured or with after-effects of the accident can contact associations that help victims of traffic accidents.
What rights do I have as a victim of a traffic accident?
- The person or persons responsible for bearing the medical costs following a traffic accident are, except in exceptional cases provided for in the policies, the insurance companies with which the compulsory insurance is signed.
- The patient is free to choose the medical center and the doctor who will treat him/her.
- The companies CANNOT decide or impose the assistance center or the type of assistance that the victim will receive.
- The patient has the right to be diagnosed and treated according to the medical criteria of the professional and the chosen medical center.
- The insurer has the obligation to cover the costs of medical assistance, surgical operations, pharmaceutical and rehabilitation operations with the necessary amount up to the sanction or consolidation.
